1. Eligibility & Account Registration

You must be at least 13 years old to use the Platform. When you create an account, you agree to provide accurate information and keep your login credentials secure. You are responsible for all activity that occurs under your account.

2. Your Use of the Platform

You agree to use Ebulence in a lawful, respectful, and culturally aligned manner. You may not:

• Engage in harassment, hate speech, or harmful behavior.
• Attempt to disrupt or interfere with the Platform’s operation.
• Use automated tools to scrape, copy, or extract data.
• Misrepresent your identity or affiliation.

We may suspend or terminate your access if you violate these Terms or harm the community experience.

3. Content You Submit

You may submit content such as posts, comments, photos, videos, or other materials (“User Content”).

By submitting User Content, you grant Ebulence a non-exclusive, worldwide, royalty-free license to use, display, reproduce, distribute, and modify your content solely for operating, promoting, and improving the Platform.

You retain ownership of your content. You are responsible for ensuring you have the rights to submit it.

4. Ebulence Content & Intellectual Property

All content provided by Ebulence — including graphics, audio, video, programming, corridor data, Kinflow interactions, QR experiences, and editorial content — is owned by Ebulence or its licensors.

You may not copy, distribute, modify, or create derivative works from Ebulence content without our permission.

5. Business & Creator Tools

If you use Ebulence’s tools for creators, businesses, or partners (including QR-at-POS, Kinflow engagement, or analytics dashboards), you agree to:

• Use the tools only for lawful business purposes.
• Respect user privacy and data protections.
• Avoid misuse of aggregated insights or corridor-level data.

Ebulence may update or discontinue these tools at any time.

6. Payments & Subscriptions

Certain features, including E+ subscriptions or premium content, may require payment.

• Prices and features will be displayed before purchase.
• Payments are processed through trusted third-party providers.
• Subscription renewals occur automatically unless canceled.
• All purchases are subject to the terms of the applicable payment provider.

7. Data & Privacy

Your use of the Platform is also governed by the Ebulence Privacy Statement, which explains how we collect, use, and protect your information.

By using the Platform, you consent to the practices described in the Privacy Statement.

8. Third-Party Services

The Platform may contain links or integrations with third-party services. Ebulence is not responsible for the content, policies, or actions of those services.

9. Disclaimers

The Platform is provided “as is” and “as available.”

We do not guarantee uninterrupted service, error-free operation, or specific outcomes from using the Platform.

To the fullest extent permitted by law, Ebulence disclaims all warranties, express or implied.

10. Limitation of Liability

To the maximum extent permitted by law, Ebulence is not liable for:

• Indirect, incidental, or consequential damages.
• Loss of data, revenue, or profits.
• Damages arising from your use or inability to use the Platform.

Some jurisdictions do not allow certain limitations, so these may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless Ebulence from any claims, damages, or expenses arising from your use of the Platform or violation of these Terms.

12. Changes to These Terms

We may update these Terms as the Platform evolves. When changes occur, we will notify you within the app or through other appropriate channels.

Continued use of the Platform after changes means you accept the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles.
